Terms & Conditions

These terms apply to your use of dbamedia.org and to services provided by DBA Media ("DBA Media", "we", "us"). By booking or purchasing our services you agree to them.

1. Services

DBA Media provides done-for-you AI-assisted social media marketing, which may include content strategy, AI avatar videos, carousels, image posts, captions, scheduling and publishing on up to seven supported platforms, a lead-generation landing page or funnel, supported comment-to-DM automation and monthly reporting. The specific deliverables are those described on our pricing page or in your service agreement.

2. Fees and billing

• The flagship service is $997 per month, billed in advance on a recurring basis.
• A one-time $497 setup fee applies at the start of service, where applicable.
• Paid advertising budgets and ad management are not included.
• Fees are in US dollars and exclude any applicable taxes.

3. Term, renewal and cancellation

The service renews monthly until cancelled. The initial commitment period (if any) and the notice required to cancel are set out in your service agreement. See our Refund & Cancellation Policy.

4. Client onboarding and responsibilities

• Provide accurate business information, brand assets and timely feedback.
• Grant and maintain access to the social accounts you want us to manage.
• Ensure your offers, claims and content comply with applicable laws, advertising rules and platform policies.
• Only supply materials you own or are licensed to use.

5. Content approval and revisions

An approval workflow is agreed during onboarding. Content may be published once approved, or as set out in that workflow. Reasonable revisions within the scope of the monthly deliverables are included; the revision process is described in your service agreement.

6. AI avatars and consent

A digital clone of a person's likeness or voice is only created with that person's documented authorization and consent. You must not request a clone of anyone who has not consented. We may refuse or remove any avatar or content we reasonably believe is unauthorized, deceptive or unlawful. See our AI Disclosure.

7. Intellectual property

You keep ownership of the materials you provide. Upon payment, finished content we create for you may be used by you for your business marketing, subject to the terms of any third-party tools, stock assets or AI presenters used to make it. We keep ownership of our methods, templates and internal tools.

8. Third-party platforms

Publishing and automation depend on third-party platforms (such as Facebook, Instagram, TikTok, YouTube, LinkedIn, X and Threads). Their features, rules, approvals and availability can change at any time and are outside our control. Features may be unavailable on some platforms or accounts.

9. No guarantee of results

We do not guarantee virality, views, follower growth, engagement, leads, revenue or sales. Results depend on your business, offer, audience, market and other factors.

10. Service availability

We aim to deliver the monthly deliverables reliably but do not guarantee uninterrupted service. Delays caused by platform outages, missing approvals or missing client materials are not breaches of these terms.

11. Payment disputes

Please contact us before disputing a charge with your bank so we can try to resolve the issue directly.

12. Limitation of liability

To the extent permitted by law, DBA Media is not liable for indirect, incidental or consequential losses, and our total liability for any claim is limited to the fees you paid in the three months before the claim arose.

13. Governing law and disputes

These terms are governed by the laws of the State of Wyoming, United States. We will first try to resolve any dispute informally by email.

14. Changes

We may update these terms. The "Last updated" date shows the latest version.
